Bluff City Exteriors LLC Warranty Agreement
This warranty agreement (the “Agreement”) is entered into between Bluff City Exteriors (referred to as the “Contractor”) and_______________________________(referred to as the “Client”) for the purpose of outlining the warranty terms for the workmanship performed by the Contractor for the project listed on the other side of this page.
- Warranty Period:
- The Contractor provides a warranty period of ________________from the date of completion of the project.
- The warranty period covers the workmanship performed by the Contractor but does not extend to the quality or performance of the materials used, which are subject to their respective manufacturer warranties.
- Scope of Workmanship:
- The warranty applies solely to the labor and workmanship performed by the Contractor in relation to the completed project as outlined in the contract or agreement.
- The Contractor’s liability is limited to the work specifically performed by the Contractor and does not extend to other aspects or systems of the property/home.
- Coverage and Limitations:
- This warranty does not cover damages or issues caused by the homeowner, acts of God, misfortune, poor maintenance, or improper use of the completed project.
- The Contractor shall not be held liable for any damages, repairs, or expenses beyond the scope of the work performed by the Contractor.
- Remedies and Repairs:
- In the event of any defect or issue covered by this warranty, the Contractor will provide necessary repairs to rectify the problem, at no additional cost to the Client.
- The Contractor will make reasonable efforts to address the issue within a reasonable timeframe upon receiving written notice from the Client regarding the problem.
- The Contractor reserves the right to determine the appropriate method of repair, including repair or replacement of the affected area, based on the nature and extent of the issue.
- Client Responsibilities:
- The Client agrees to properly maintain the completed project in accordance with industry standards and any maintenance guidelines provided by the Contractor.
- Routine maintenance tasks, including cleaning, inspection, and necessary upkeep, are the sole responsibility of the Client and are not covered under this warranty.
- Dispute Resolution:
- In the event of any dispute arising from or relating to this warranty agreement, both parties agree to engage in good faith negotiations to reach an amicable resolution.
- If the dispute cannot be resolved through negotiations, both parties may seek mediation or arbitration as a means of alternative dispute resolution.
- Transferability:
- This warranty is non-transferable and applies solely to the original client named in the contract with the Contractor.
- Any transfer of ownership or change in client shall not extend the warranty coverage to subsequent owners or clients.
- Non-Warranty Repairs:
- Any repairs or modifications requested by the Client that fall outside the scope of the original contract, or are not directly related to the workmanship performed by the Contractor, shall be considered non-warranty repairs.
- The Client shall be responsible for any costs associated with such repairs or modifications.
- Limitation of Liability:
- The Contractor’s liability under this warranty is strictly limited to the repair or replacement of defective workmanship.
- The Contractor shall not be held responsible for any indirect, consequential, or incidental damages, including but not limited to loss of use, loss of profits, or other economic losses arising from the warranty claim.
Please note that this warranty agreement is specific to the workmanship performed by the Contractor and does not extend to the quality or performance of the materials used. The Contractor’s liability is limited to the work performed by the Contractor, and future cleanliness is not part of the warranty coverage.
